Agreement to Terms

These Terms of Service ("Terms") govern your use of NC Fence Co's website, services, and any fence installation, repair, or maintenance work performed by NC Fence Co ("Company," "we," "our," or "us"). By accessing our website, requesting our services, or entering into a service agreement with us, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our website or services. We reserve the right to modify these Terms at any time, and your continued use of our services constitutes acceptance of any changes.

Services Description

NC Fence Co provides professional fence installation, repair, and maintenance services in Wilmington, NC, and surrounding areas. Our services include but are not limited to:

• Residential fence installation (vinyl, wood, aluminum, chain link)
• Commercial fence installation and security fencing
• Fence repair and maintenance services
• Pool fence installation and safety fencing
• Privacy fence installation and design
• Emergency fence repair services
• Fence removal and replacement services
• Gate installation and repair

All services are subject to availability, site conditions, and applicable local building codes and regulations.

Estimates and Pricing

Free Estimates

We provide free, no-obligation estimates for fence installation and repair services. Estimates are valid for 30 days from the date of issue unless otherwise specified. All estimates are based on the information provided by the customer and may be subject to change based on actual site conditions discovered during installation.

Pricing and Payment

• All prices are subject to change without notice until a written contract is signed
• Payment terms will be specified in your service agreement
• We accept cash, check, and major credit cards
• Financing options may be available for qualifying customers
• Late payment fees may apply as specified in your contract
• All prices are exclusive of applicable taxes and permits unless otherwise stated

Service Agreements

All fence installation and repair work is performed under a written service agreement that includes:

• Detailed description of work to be performed
• Materials to be used and their specifications
• Total project cost and payment schedule
• Project timeline and completion date
• Warranty terms and conditions
• Customer responsibilities and requirements
• Change order procedures

The service agreement supersedes any verbal agreements or discussions and constitutes the entire agreement between the parties unless modified in writing and signed by both parties.

Customer Responsibilities

To ensure successful project completion, customers are responsible for:

• Providing accurate property information and access to the work area
• Obtaining necessary permits and approvals (unless specified in the contract)
• Marking property lines and underground utilities
• Removing obstacles that may interfere with installation
• Providing access to water and electricity if required
• Ensuring the work area is safe and accessible
• Notifying us of any HOA requirements or restrictions
• Making payment according to the agreed schedule

Warranties and Guarantees

Workmanship Warranty

We warrant our workmanship for a period of one (1) year from the date of completion, provided that:

• The fence is used for its intended purpose
• Normal maintenance is performed as recommended
• Damage is not caused by customer negligence, abuse, or acts of nature
• No modifications are made to the fence without our written approval

Material Warranties

Materials used in fence installation are covered by manufacturer warranties. We will assist customers in processing warranty claims but are not responsible for manufacturer defects or material failures beyond our control.

Warranty Limitations

Our warranty does not cover damage caused by acts of God, natural disasters, vandalism, customer negligence, or normal wear and tear. Warranty claims must be reported in writing within 30 days of discovery of the issue.

Limitation of Liability

To the maximum extent permitted by law, NC Fence Co's liability for any claims arising from our services shall not exceed the total amount paid by the customer for the specific work in question.

We shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, business interruption, or property damage, regardless of the cause of action.

This limitation of liability applies to all claims, whether based on contract, tort, negligence, or any other legal theory, and survives termination of these Terms.

Insurance and Licensing

NC Fence Co is fully licensed, bonded, and insured in the state of North Carolina. We maintain:

• General liability insurance
• Workers' compensation insurance
• Professional liability insurance
• Valid contractor's license
• Bonding as required by law

Proof of insurance and licensing is available upon request. We are committed to maintaining all required insurance and licensing throughout the duration of our business operations.

Force Majeure

We shall not be liable for any delay or failure to perform due to circumstances beyond our reasonable control, including but not limited to:

• Acts of God, natural disasters, or severe weather conditions
• War, terrorism, or civil unrest
• Government actions, regulations, or restrictions
• Labor disputes or strikes
• Material shortages or supplier delays
• Utility outages or infrastructure failures

In such circumstances, we will make reasonable efforts to resume performance as soon as practicable and will notify customers of any significant delays.

Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through the following process:

1. Direct Negotiation: Parties will attempt to resolve disputes through good faith negotiation
2. Mediation: If negotiation fails, disputes may be submitted to mediation with a mutually agreed mediator
3. Arbitration: If mediation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association
4. Governing Law: These Terms shall be governed by the laws of the State of North Carolina

Termination

Either party may terminate a service agreement under the following circumstances:

• Material breach of contract by the other party
• Non-payment of fees after written notice and cure period
• Mutual agreement of both parties
• Impossibility of performance due to circumstances beyond control

Upon termination, customers shall pay for all work completed and materials provided up to the date of termination. We reserve the right to place a lien on the property for unpaid amounts as permitted by law.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes constitutes acceptance of the modified Terms.

For existing service agreements, the terms in effect at the time of contract execution shall govern unless both parties agree to modifications in writing.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
